1. Agreement
These Terms & Conditions (“Terms”) govern your access to merciefoundation.org and any related services operated by Mercie Animal Welfare Foundation (“Mercie Foundation”, “we”, “us”). By using the site, browsing, creating an account, or placing an order, you agree to these Terms and our Privacy Policy.
2. Our mission & nature of services
Mercie Foundation is an animal welfare organisation. Proceeds from cruelty-free products support rescue, care, and awareness programs. Product descriptions and imagery aim to be accurate; minor variations in colour, texture, or craftsmanship may occur with handmade or natural materials.
3. Eligibility & accounts
You must be legally able to enter contracts in India (or your jurisdiction) to make a purchase. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of unauthorised use.
4. Products, pricing & availability
Prices are listed in Indian Rupees (INR) unless stated otherwise and may change without notice before you complete checkout. We reserve the right to limit quantities, refuse or cancel orders (including after confirmation) where there is an error in listing, suspected fraud, or stock unavailability — in such cases we will notify you and refund applicable amounts per our Refund Policy.
5. Orders & payment
When you place an order, you offer to purchase the items selected. Acceptance occurs when we confirm shipment or otherwise expressly accept the order. Payments are processed securely through our payment partners (such as Razorpay). You agree to provide accurate billing and shipping information and authorise us (and our processors) to charge your chosen payment method for the total amount due.
6. Shipping & risk
Delivery timelines are estimates and depend on carriers and your location. Risk of loss or damage passes to you upon delivery to the address provided, except where mandatory consumer laws provide otherwise.
7. Intellectual property
All content on this site — including text, graphics, logos, and photography — is owned by Mercie Foundation or our licensors. You may not copy, modify, distribute, or exploit such content without prior written permission, except for limited personal, non-commercial use as permitted by law.
8. Acceptable use
You agree not to misuse the site: no unlawful activity, harassment, malware, scraping that degrades our systems, or attempts to gain unauthorised access. We may suspend or terminate access for violations.
9. Disclaimer & limitation of liability
The site and products are provided on an “as is” and “as available” basis to the fullest extent permitted by law. To the extent permitted by applicable law, Mercie Foundation and its team disclaim implied warranties and shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the site or products. Our aggregate liability for any claim relating to an order shall not exceed the amount you paid for that order.
10. Indemnity
You agree to indemnify and hold harmless Mercie Foundation from claims, damages, or expenses arising from your breach of these Terms or misuse of the site, where permitted by law.
11. Governing law & disputes
These Terms are governed by the laws of India. Courts at Mumbai, Maharashtra shall have exclusive jurisdiction subject to any non-waivable rights you may have under consumer protection laws.
